Terms & Conditions for TESTMATE®©

General Terms

By accessing and placing an order with TESTMATE®©, you confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below. These terms apply to the entire website and any email or other type of communication between you and TESTMATE®©.

Under no circumstances shall TESTMATE®© team be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if TESTMATE®© team or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

TESTMATE®© will not be responsible for any outcome that may occur during the course of usage of our resources. We reserve the rights to change prices and revise the resources usage policy in any moment.

License

TESTMATE®© grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the app strictly in accordance with the terms of this Agreement.

These Terms & Conditions are a contract between you and TESTMATE®© (referred to in these Terms & Conditions as "TESTMATE®©", "us", "we" or "our"), the provider of the TESTMATE®© website and the services accessible from the TESTMATE®© website (which are collectively referred to in these Terms & Conditions as the "TESTMATE®© Service").

You are agreeing to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, please do not use the TESTMATE®© Service. In these Terms & Conditions, "you" refers both to you as an individual and to the entity you represent. If you violate any of these Terms & Conditions, we reserve the right to cancel your account or block access to your account without notice.

Meanings

• Cookie: A small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, and remember information about you such as your language preference or login information.
• Company: when this policy mentions Company, it refers to TEACHFLY EDUCARE PRIVATE LIMITED through BHAVIK DEVRAJ KOTHARI, ADDRESS: having its Registered Office at 904-905, Pride Enclave, Zeus B, BPD Road, Vishnunagar, Naupada, Thane-Maharashtra-400602, that is responsible for your information under this Terms & Conditions.
• Country: where TESTMATE®© or the owners/founders of TESTMATE®© are based, in this case is India
• Device: Any internet connected device such as a phone, tablet, computer or any other device that can be used to visit TESTMATE®© and use the services.
• Service: refers to the service provided by TESTMATE®© as described in the relative terms (if available) and on this platform.
• Third-party service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
• Website: TESTMATE®© site, which can be accessed via this URL: www.testmate.in.
• You: a person or entity that is registered with TESTMATE®© to use the Services.

Educational Courses

TESTMATE®© provides educational content/study material through engineered courses, tests, training, coaching, and other services on the app from time to time. The scope of the education material used/relied upon is accordance with CERTIFICATE FOR USE OF CONTENT OF TEXT BOOK, REGISTRATION NO: 2021MH0005 issued to Teachfly Educare Pvt Ltd (parent company of TESTMATE®© ) by “BALBHARATI”, Maharashtra State Bureau of Text Book Production and Curriculum Research, Pune. Following are the terms of our services provided:

• Any access to our Services/Application/products through registrations/subscription is non-transferable.
• Each course is valid for 12 months from the date of enrolment.
• Regular test series are provided as per the syllabus.
• A provision of Schedule tests is additionally provided. These are specialised tests conducted other than the regular test series. They provided easier and quick methods of learning. These scheduled tests are included in our current packages. However, the consumer can chose to exclusively purchase schedule tests, besides our standard packages.
• In addition to the above, TESTMATE®© also provides counselling as service by certified professionals (including professors/course leaders) to the students. Counselling is a 15 min one on one virtual interaction between the councillor and the student, in order to absolve any confusion/worries. They do not guarantee your doubts would be solved; however, an approach will be used to come to the best possible outcome in the given scenario. The consumer can chose to exclusively purchase counselling, besides our standard packages.
• The current promotional packages available to purchase are:
  • Beginner at Rs. 251/- p.a. - All inclusive access to test series, 3 schedule tests and 1 session of counselling.
  • Intermediate at Rs. 351/- p.a. – All inclusive access to test series, 5 schedule tests and 3 session of counselling.
  • Advanced at Rs. 551 p.a. - All inclusive access to test series, 10 schedule test and 5 session of counselling.
• TESTMATE®© provides subscribers the facility to connect with one other and take the aforesaid courses/tests/counselling together by collaborating, thereby encouraging development of knowledge and skills simultaneously between peers. This facility can be purchased in addition to redemption of points as per the current point system. Points can be redeemed to avail of this facility by all the subscribers.

Restrictions

• You agree not to, and you will not permit others to:
  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the app or make the platform available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the app.
  • Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of TESTMATE®© or its affiliates, partners, suppliers or the licensors of the app.
